This includes pages consisting of or containing the tulsk.ie address, for example, services.tulsk.ie, tulsk.ie/contact, tulsk.ie/news. These Terms of Use apply to usage of all services provided by us, including access to our site via desktop, as well as mobile and app usage. The use of the “Website”, “Site”, or “tulsk.ie” and the provision of our advertising services on the Website are subject to you accepting the Terms of Use (defined below).

The agreement between you and us in relation to your use of the Website (the “User Agreement”) consists of these terms and conditions of use (“Terms of Use”) and the policies referred to in clause 11 below (each a “Policy” and together the “Policies”), all of which you should read carefully before you start to use the Website.

Users acting in a commercial or professional capacity who offer goods to consumers on Tulsk for purposes relating to trade or business in accordance with Clause 19 (“Business Users”) are Business Users for the purposes of these Terms.

2. Your Consent

Please review the Terms of Use and each Policy carefully. By accessing and using the Website, you confirm that you have read, understand and accept the Terms of Use and the Policies and that you agree to abide by their respective terms each time you access and use the Website. If you do not agree with any of the Terms of Use or any Policy, you may not use the Website.

Registered users of our site will be required to agree to these Terms of Use in order to carry out core services provided by the Site.

3. Modification of Terms

Tulsk may modify the Terms of Use and any Policy at any time. Registered users will be notified when we make changes to the Terms of Use by email at least 15 days before they become effective, during which the registered user may terminate this Agreement if they do not agree with the revisions. Business Users may waive this termination right by creating new advertisements on the Website, which shall constitute acceptance of these revised terms. Any changes to the Terms of Use and Policies applicable to other users shall be notified on the Website and any continued use of the Website means any such user shall be deemed to have read, understood and agreed to be bound by the then prevailing Terms of Use and Policies.

By continuing to access, browse and use the Website, unregistered users will be deemed to have agreed to any changes or updates to the Terms of Use and any Policy.

4. Information About Us and Legal Status

The Website and the Tulsk Service (defined below) are operated by Tulsk.ie (“we”, “us” or “our”). Tulsk.ie is currently operated as a sole trader based in Ireland. All income derived from advertising or associated services is declared in accordance with Irish Revenue requirements. Users are not contracting with a limited company but with the sole proprietor operating Tulsk.ie.

All inquiries, including those of a general or statutory nature, should be directed to contact@tulsk.ie.

4.1 Future Incorporation
In the event tulsk.ie becomes incorporated or transfers ownership, all existing agreements and user accounts shall continue under equivalent terms with the new operating entity. Users will be notified in advance of any material change.

5. Access to and use of the Website and the Tulsk Service

Age and responsibility
The use of the Website and/or the Tulsk Service by a minor (under 18 years of age) is subject to the consent of their parent or guardian, who is responsible for compliance. Minors should be made aware of online risks.

You are responsible for all arrangements necessary for access to the Website and/or the Tulsk Service, and for ensuring all persons accessing through your connection, including minors, are aware of and comply with these terms.

The Tulsk Service allows you to: create and manage advertisements for sales, services, rental, or leasing; contact other users; search our database; and download portions of information (“Content”).

You may use the Website for personal or commercial use strictly in accordance with this User Agreement.

NO FIDUCIARY RELATIONSHIP DISCLAIMER: tulsk.ie is strictly a technology platform facilitator. We do not act as your agent, broker, financial advisor, or partner in any transaction. No fiduciary duties are established between you and tulsk.ie.

6. Registration of accounts, usernames and passwords, deactivating accounts

Registration is required for core services (placing advertisements, interacting). You are responsible for keeping your password secure and must not input account information into any website purporting to offer services for tulsk.ie. All supplied information must be accurate.

Names and Email Addresses
You may not use a name or email address containing “Tulsk” or otherwise misrepresenting your relationship with tulsk.ie.

Accounts and Passwords
You are responsible for all actions under your account. We will not be liable for any loss you incur due to unauthorized use of your credentials if you failed to take reasonable security steps. By providing your email, you consent to receiving service-related notices from tulsk.ie, including transactional notifications, which are integral to the service and not opt-out eligible.

7. Using and accessing the Website, Content and the Tulsk Service

We reserve the right to disable any User Identifier if you fail to comply with the Terms of Use.

COMMUNICATION AND SYSTEM RELIABILITY EXCLUSIONS:
The messaging function on tulsk.ie is provided AS IS, WHERE IS, AND WHEN AVAILABLE, for facilitating contact only. WE EXPRESSLY DISCLAIM ALL LIABILITY for any failure in delivery, timeliness, data corruption, or receipt of messages between users caused by poor network coverage, mobile device status, system glitches, server overload, or any factors external to tulsk.ie’s immediate operational control. No warranty is made as to the accuracy or completeness of inter-user communications.

tulsk.ie retains the right to monitor, retain, and disclose information as necessary to satisfy legal process or regulatory requests.

DSA & Content Moderation: tulsk.ie acts as a service provider and is not obligated to proactively monitor all user activity. We adhere to a “notice and take down” policy under the Digital Services Act (DSA). We rely on substantiated notice of illegal content sent to contact@tulsk.ie for enforcement action. Any notice received outside operating hours (9 am to 5 pm, Mon–Fri, ROI Public Holidays excluded) will only be addressed upon resumption of normal operations.

reliance and Accuracy Disclaimer: You should not rely on any Content on tulsk.ie for decisions. We expressly disclaim all liability arising from any reliance placed on such Content or materials by any user. We accept NO RESPONSIBILITY for keeping information current.

We reserve the right to refuse to publish any content without prior notice for any reason.

Identity Disclosure for Paid Ads: If a fee was paid for an advertisement, you have the right to request the advertiser’s identity by emailing contact@tulsk.ie with justification.

8. Restrictions on Right to Use

You shall not (and shall not permit others to):

• Reverse engineer, modify, or tamper with the tulsk.ie Service or Website architecture.
• Promote competitor services or place an undue or unfair burden on tulsk.ie support teams or IT infrastructure (imposing disproportionately large loads).
• Use automated means (robots/spiders) to retrieve data for the purpose of populating an external database or monitoring tulsk.ie.
• Use the service to violate the security of any computer network or crack encryption.
• Post offensive material or harvest personal data outside the intended purpose of responding to legitimate advertisements.

9. Your Interactions with Other Users

We do not verify the identity of users connecting to the Website. All dealings, including payment and delivery arrangements, are solely between you and the other user. We are under no obligation to intervene in disputes. Use caution; exercise discretion when volunteering personal information publicly, as it may be available worldwide. You must comply with Data Protection Laws concerning any user information you collect.

10. Content Standards

You are solely responsible for any Content you submit. By posting, you grant tulsk.ie a perpetual, royalty-free license to use, copy, display, and prepare derivative works of that Content, including combining it with other users’ data to create searchable databases.

Content must be accurate where factual and must comply with Irish equality and non-discrimination legislation.

10.1.1 Dealership Ad & 10.1.2 Ad Slot: Commercial terms regarding Ad Slots are subject to the specific subscription package purchased on tulsk.ie (e.g., Cruise, Accelerator). Overuse of contracted slots may result in automatic tier upgrades and corresponding billing adjustments for the subsequent period.

12. Suspension and termination

tulsk.ie may immediately terminate your access or delete any advertisement without prior notice at our sole discretion for breaches of the User Agreement, including posting manifestly illegal content or content restricted under Clause 8. We are not liable to you or any third party for the termination of access or Content removal. Users suspended due to alleged illegal content will be informed of the reasons and offered clarity via internal process.

13. Your concerns and complaints

If you believe content on tulsk.ie breaches the User Agreement or is illegal, notify us via the ‘Report this Ad’ mechanism or write to contact@tulsk.ie, detailing the breach reference. If you are unhappy with a decision to remove content or suspend access, you have the right to lodge a formal, free complaint within six months to contact@tulsk.ie.

14. Disputes with third parties

You must notify contact@tulsk.ie immediately if legal proceedings are threatened against you relating to your use of tulsk.ie. You must stop the complained-of act immediately if requested.

15. Payment for advertisements

Publication is subject to payment of the Fee to tulsk.ie. Fees are quoted in Euro or Pounds and are payable in those currencies.

MANDATORY PAYMENT GATEWAY: The Fee MAY ONLY be paid using PayPal or via a credit/debit card securely processed through the dedicated PayPal portal on tulsk.ie. We are not responsible for the services, security, or terms of PayPal.

Legal Name Disclosure: If you pay a Fee for an advertisement on tulsk.ie, tulsk.ie is required by law to provide your full name to any recipient of the advertisement upon a justified request from that individual.

15.1 Payment Transparency
All payments made through PayPal are processed to the registered PayPal account associated with tulsk.ie. Users will see this entity name in their transaction summary. tulsk.ie does not store or process credit or debit card details directly.

16. Cancellation policy

Once your advertisement is posted on the Website, the request for service is deemed accepted and CANNOT BE CANCELLED at that stage. You may cancel prior to publication by contacting contact@tulsk.ie.

NON-REFUND FOR PUBLISHED ADS: Once published, the service has been rendered. There are NO REFUNDS for published advertisements. This rule applies whether the ad is removed voluntarily or by tulsk.ie enforcement.

17. Published advertisements and duration of advertisements

An advertisement order is accepted only upon confirmed payment receipt by tulsk.ie. Advertisements are displayed for [Insert Fixed Duration, e.g., two months], requiring further payment to extend.

Ranking factors determining visibility depend on several parameters, including premium payments made and user filtering choices within tulsk.ie.

18. Advertising terms and conditions

Advertisements must be accurate. Duplicate advertisements or listings containing offensive material are prohibited. tulsk.ie reserves the right to review and reject advertisements of an adult theme, using no graphic images. Violations result in removal without notification and no refund.

19. Commercial Terms

Business Users must designate their trading status on their profile. They are wholly responsible for adhering to all applicable Irish and EU consumer protection legislation, including regulations concerning misleading advertising and distance communications. tulsk.ie reserves the right to restrict services if necessary, providing explanation at least 30 days in advance where applicable under P2B regulations.

20. Fair usage policy

We strictly enforce the rule of one item/product per advertisement. Multiple listings for the same item across different sections or counties will result in removal without notice or refund.

21. Reporting breaches

Please utilize the ‘Report this Ad’ mechanism or contact contact@tulsk.ie to report breaches of the User Agreement.

22. Standards

All advertisements must adhere to the ‘Code of Advertising Standards’ of The Advertising Standards Authority for Ireland.

23. Responsibility

You are solely responsible for the Content of your advertisements and for the resultant transactions. tulsk.ie expressly disclaims liability for any reliance placed on advertisement Content.

24. Consequences for failure to comply with the Agreement

Breach may trigger immediate withdrawal of service, removal of Content, private warnings, restriction of User Identifier usage, initiation of legal proceedings for indemnity recovery (including reasonable legal costs), or disclosure to law enforcement via contact@tulsk.ie.

25. Banner advertising

Banner advertisements are managed by third parties. Any agreement reached with a Banner Advertiser appearing on tulsk.ie is solely between you and that advertiser; we are not responsible for their services.

26. Refund policy

Where tulsk.ie rejects or removes Content, we have a policy of NOT issuing refunds. Advance guidance on advertisement suitability can be sought by contacting contact@tulsk.ie.

27. AI Assistant

Any AI assistant on tulsk.ie provides information only for general guidance and should not substitute specialist advice. tulsk.ie does not warrant the accuracy of AI responses. Users must not enter personal information into the assistant tool.

28. SMS information service

The SMS Service utilizes third-party mobile networks. tulsk.ie is not liable for transmission delays, failures, or the ultimate accuracy of alerts, as these factors are outside our control.

29. Intellectual property

All Protected IP on tulsk.ie, except for User Content, is owned by tulsk.ie or its licensors. Use of tulsk.ie trademarks requires express written permission. You waive all moral rights in any Content you submit.

30. Disclaimer of liability

The Website and the Tulsk Service are provided strictly on an ‘as is’ basis. You may not rely on any Content or material for decision-making. We disclaim all liability arising from reliance on such materials by any user. We accept NO RESPONSIBILITY for keeping information up to date.

To the extent permitted by law, we expressly exclude:
a) All conditions, warranties, and terms implied by statute, common law, or equity.
b) ANY LIABILITY FOR ANY LOSS OF INCOME, REVENUE, BUSINESS, PROFITS, CONTRACTS, ANTICIPATED SAVINGS, DATA LOSS, GOODWILL, WASTED MANAGEMENT TIME, OR ANY OTHER DIRECT, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE INCURRED by any user in connection with the use of the Website or Tulsk Service, however arising (including tort/negligence), even if foreseeable.

Nothing in these Terms excludes or limits liability for death or personal injury caused by proven negligence of tulsk.ie or for fraudulent misrepresentation.

tulsk.ie shall not be liable for failure to perform obligations caused by matters beyond reasonable control. We will NEVER be liable for Content errors, or any loss incurred as a result of denial of access to Content.

We cannot guarantee the security of the internet, hardware, or software used by users, nor guarantee access will be continuous or error-free. Any material downloaded is done entirely at your own risk.

31. Indemnity

You shall indemnify and keep tulsk.ie (including its holding company, subsidiaries, officers, directors, agents, and suppliers) indemnified on demand against all liabilities, costs, and expenses (including legal fees) arising from:
a) Any breach of the User Agreement; or
b) Your access or use of tulsk.ie in a manner that infringes applicable law or the rights of any third party.

32. Disclaimer of endorsement

Content on the Website referring to third-party trade names or trademarks does not constitute endorsement, recommendation, or validation by tulsk.ie.

33. Links to the Website

You may link to tulsk.ie only if it is fair, legal, and does not suggest any association, approval, or sponsorship without our express written permission. Linking permission may be withdrawn without notice.

Where tulsk.ie contains links to external sites, these are provided for information only. We have no control over, and accept no responsibility for, the contents of those resources or any loss arising from their use.

The User Agreement is governed by, and construed in accordance with, Irish law. The courts of Ireland shall have exclusive jurisdiction to settle any dispute, save that tulsk.ie retains the right to bring proceedings against you in your country of residence or any other court of competent jurisdiction.

38. Waiver, Rights Cumulative

Failure or delay by tulsk.ie in exercising a right or remedy does not constitute a waiver of that right or remedy. All rights provided are cumulative.

39. Severability

If any provision of the User Agreement is found to be illegal or unenforceable under Irish law, that provision shall not affect the legality or enforceability of the remainder of the User Agreement.

40. Assignment and entire agreement

tulsk.ie may assign or subcontract its rights and obligations under this Agreement at our discretion. You may not assign your rights without our prior written consent. This document and the Policies contain the entire agreement between the parties regarding the Website, superseding all prior arrangements, save for fraud.

41. Submissions

You acknowledge and agree that any feedback, comments, suggestions, or ideas provided to tulsk.ie regarding the Service are non-confidential and may be used by us at our discretion without attribution or compensation.

Information regarding how we use your data and your rights under Data Protection Law can be found in our Privacy Policy, linked on the site.

43. Business User Complaints Procedure

Business Users must submit complaints regarding non-compliance with the Platform to Business Regulation, technological issues affecting service provision, or tulsk.ie behaviour via email to contact@tulsk.ie A preliminary decision will follow 15 business days after receipt of all requested information, offering you a chance to comment before a final decision is issued.

44. Business User Mediation Services

For Business Users unhappy with the final outcome of internal complaint handling (Clause 43), mediation services are available at recognized centers in Dublin and London [Details to be inserted, matching original structure].

45. Age Verification Disclaimer

While tulsk.ie prohibits illegal material, we cannot guarantee the perfect verification of age for users intending to engage in regulated trade activity; ultimate legal responsibility for adherence to age restrictions rests with the listing advertiser.

46. Third-Party Verification Seals

If tulsk.ie utilizes any third-party “Trust Seals” or verification badges on listings, these are based on data analysis and external factors chosen by tulsk.ie. These seals serve only as informational signals for buyers and DO NOT constitute a guarantee or warranty by tulsk.ie as to the trustworthiness or future performance of the seller. Buyers must conduct their own necessary due diligence.

47. Liability for Third-Party Data Accuracy

We make no guarantee as to the accuracy or truthfulness of any user-provided data, including self-descriptions or relationships described in listings.

48. Non-Reliance on Information

Any advice, guidance, or information shared within advertisements, or via promotional materials provided by tulsk.ie support staff in the context of using the advertising features, is informational only and does not create a warranty or contractual obligation outside these Terms.

49. Intellectual Property Indemnity Waiver

To the extent you possess any moral rights in Content submitted to tulsk.ie, you waive any entitlement to assert those rights against tulsk.ie or our licensees/successors.

50. Termination Compliance Record Keeping

Following account termination or data deletion requests, tulsk.ie may retain user data as required to comply with legal obligations, including responding to ongoing or anticipated law enforcement inquiries, in accordance with our Privacy Policy.

51. Responsibility for Taxes and Compliance Costs

You agree to bear all costs associated with proving your compliance, or defending against claims arising from your non-compliance, with local laws, regulations, and this User Agreement.

52. Limitation on Data Portability

Information generated during your contractual relationship with tulsk.ie (e.g., statistics, correspondence copies) may not be retrievable once account access is terminated, subject only to data retention laws and obligations for mandatory disclosure.

53. Handling of Illegal Content Notices

Notices claiming content hosted on tulsk.ie is illegal must contain a detailed explanation assessing illegality. If a notice is found to be manifestly unfounded or constitutes an abuse of process, tulsk.ie reserves the right to suspend the reporting user’s ability to submit further notices.

54. External Site Data Responsibility

While tulsk.ie aims to mark external links clearly, we accept no responsibility for the content, security practices, or privacy policies of external websites referenced, including those belonging to payment providers or data check services.

55. Service Specifics (SMS)

We reserve the right to amend, alter, or terminate the SMS Service at any time without notice.

56. Advertising Policy Adherence

Breaching applicable tulsk.ie policies, in addition to these Terms, will result in advertisement removal without refund.

57. Disclaimer on ‘Trusted’ Signals

If tulsk.ie employs internal scoring or ‘Trusted’ badges based on historical data, these signals are informational only and do not guarantee the trustworthiness of any seller or transaction outcome. Buyer due diligence remains essential.

58. Governing Authority References

All statutory references herein (e.g., Digital Services Act, Copyright Act) are interpreted as the legislation currently in force in the Republic of Ireland and as amended or replaced from time to time.

59. Notices to Registered Users

Unless otherwise stated, mandatory notices concerning registered users will be sent to the last provided email address on file, considered received upon sending.

60. Acceptance of Full Terms

By continuing to use tulsk.ie, you affirmatively acknowledge understanding and agreement with Clauses 1 through 59, including the absolute exclusions of liability detailed in Clauses 7, 30, and 50, and the payment terms of Clause 15, all actionable only through contact@tulsk.ie (excepting specific appeal addresses).

Effective Date: These Terms of Use are effective as of 20 October 2025 and supersede all prior versions.
